These Terms of Service and End User License Agreement (hereinafter referred to as "this Agreement") constitute a legal agreement between you and BAD SOFTWARE LLC (hereinafter referred to as "we," "us," or "our"), and set forth the terms and conditions governing your use of the mobile applications provided under this Agreement (hereinafter referred to as the "Application") and the website https://www.badwareword.com (hereinafter referred to as the "Website"). The Application and the Website are collectively referred to as the "Services." By downloading, installing, and/or using the Application, or by accessing and/or using the Website, you agree to be bound by and comply with the terms and conditions of this Agreement.

1. Limited License to Services and Content

Subject to the terms and conditions of this Agreement, BAD SOFTWARE LLC grants you a personal, limited, non-exclusive, non-transferable license to install and use the Application on any device you own or control, subject to the usage rules set forth in the Apple App Store Terms of Service or the Google Play Store Terms of Service.

2. License Restrictions

You agree that when using any BAD SOFTWARE LLC Services, you will never:

  • Initiate, assist in, or participate in any type of attack, including any type of hacking, the dissemination of viruses, worms, adware, or any harmful/malicious code on the Services, or other conduct that damages the Services or interferes with others' use of the Services.
  • Harass, bully, or threaten other users, or post or submit any abusive, threatening, bullying, obscene, harassing, offensive, pornographic, or illegal content, or any content that infringes or violates the rights of other users.
  • Exploit any bugs or defects found in the Services and/or distribute them, nor promote their use to other users in any manner.
  • Attempt to access other users' accounts, collect or obtain others' personal information, or attempt to obtain other users' login credentials.
  • You shall not attempt to gain unauthorized access to the Services, accounts registered by others, or networks providing part of the Services, including bypassing or circumventing robot exclusion headers or the security mechanisms of the Services;
  • Apply any software, device, technology, or code to the Services, attempt to send content, web spiders, hack, or crawl the Services, nor obtain or manipulate data from the Services, including any user data;

3. User-Submitted Content

By posting or uploading User-Submitted Content through the Services, you grant BAD SOFTWARE LLC a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, distribute, create derivative works from, display, and perform the User-Submitted Content for its business purposes (including marketing and advertising in any media format).

4. Disclaimer and Limitation of Liability

The Services and all content are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind. BAD SOFTWARE LLC shall not be liable for any direct, indirect, special, consequential, or punitive damages (whether foreseeable or not) arising out of this Agreement.

5. Governing Law and Jurisdiction

This Agreement and any disputes arising out of or in connection with this Agreement shall be governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of laws principles.

Updates and Modifications

BAD SOFTWARE LLC reserves the right to modify, change, or update any part of the Services, such as virtual goods, virtual in-game items, and other features and service specifications, with or without prior notice or liability to you. You acknowledge and agree that BAD SOFTWARE LLC may require you to accept and download necessary updates for further use and support of the BAD SOFTWARE LLC Services. You also acknowledge and agree that we may automatically update and/or modify the Services without manual installation, with or without prior notice to you.

Termination

You understand and agree that if any term is violated, whether such violation is accidental or intentional, these Terms of Use will automatically terminate. Upon termination, you must immediately stop using any Services. You acknowledge and agree that BAD SOFTWARE LLC reserves the right to terminate or disable your account at any time, for any reason or no reason, with or without prior notice.

Liability

Without limiting its own liability, BAD SOFTWARE LLC disclaims all express or implied warranties that the Services provided are suitable for your purposes, uninterrupted, secure, error-free, virus-free, functional, or free of harmful components. Any BAD SOFTWARE LLC Services are provided "AS IS."

In no event shall BAD SOFTWARE LLC be liable to you or any other person for any indirect or direct, incidental, consequential, special, or punitive damages (including but not limited to actual losses, loss of profits, whether under any legal theory, strict liability, or otherwise, loss of data, loss of business), whether or not BAD SOFTWARE LLC has been advised of such damages.
